By using or accessing our website, you agree to be legally bound by these Terms and Conditions of use as they apply to your use of or access to our website.

If you do not wish to be bound by these Terms and Conditions then you may not use our website.

Our website is a place for you to select and order car hire in Spain. Details of the car hire and the supplier are shown on our website next to each product. Car hire is subject to the Terms and Conditions imposed by the supplier. In the event of any conflict between the Terms and Conditions of sale of the supplier and these Terms and Conditions, the Terms and Conditions of the supplier shall prevail.

By using this site you acknowledge the contract for sale and purchase of the car hire in question is exclusively a contract between yourself and the supplier of the car hire.

You will be subject to the specific terms of the supplier of car hire set out below:

THE MAIN DRIVER OF THE HIRE VEHICLE MUST HAVE A VALID CREDIT CARD UNLESS OTHERWISE STATED

Delpaso Terms

The car hire prices include: 

• Free shuttle service from / to our airport station during normal office hours.

• 24 hours road assistance.

• VAT 21% and all other taxes.

•  Damage insurance (CDW) with excess, occupants insurance and insurance against theft (always and only when the keys of the car are returned and the theft has been reported to the closest police station). To avoid the car being stolen with its keys make sure you do not leave it unattended.

Accident – police – damage report must be forwarded within 24 hours to Del Paso Car Hire in case of damage to the car. The report must be filled in with all details of parties involved and signed by both. If not forwarded or if a misrepresentation of facts is forwarded, the full costs will be charged to client).

The car hire prices do not include: 

• Additional drivers - €6 Euros per day with a minimum €18 Euros & maximum €72Euros

• Tow truck due to driver´s negligence, lost or damages to wheels, glass, damage to clutch due to misuse, damage to underbody and roof, cleaning of upholstery, error in refueling and costs involved; battery recharge; damages caused due to driver´s miscalculation of the measures of the vehicle such as height, length, width; damages caused due to driving on untarmacked roads; any other items not specifically mentioned as “included”.

• Any kind of fine incurred during the hire period is the responsibility of the driver. In the event of a fine being received the amount of €40 administration fee will be charged to the customer

•  Baby / booster seat - €6 Euros per day with a minimum €36 Euros & maximum €72 Euros

•  ** Out of hours: an additional fee of €40 Euros applies for any booking being picked up or dropped off between 23:00 and 07:00 hours (complete flight details are mandatory). Both ways €60 Euros

• One way rentals to/from islands or the Spanish enclaves Ceuta & Melilla : NOT ALLOWED.

FUEL: Standard check-out Service: The fuel must be prepaid when collecting the car and what is not consumed will be returned. This option includes 20€ of management fee non-refundable.

Diesel Charge - Customers wishing to have a diesel car will be charged €2 Euros per day with a minimum of €10 Euros and a maximum of €30 Euros

GPS / navigator, on request - €9 Euros per day with a minimum €27 Euros & maximum €90 Euros (€100 Euros deposit required)

MIFI devices on request - €9 Euros per day with a minimum €30 Euros & maximum €90 Euros

We offer 1 hour courtesy period after the end time of the contracted rental without charge. After this time an extra day can be charged at the current rate.

Excess: The amount of the excess fee varies per vehicle group.

* Groups A, A1, B (excess €1,200 euros)
* Groups C, D, D1, E, E2, F, F1, F2, H, H1, J1, M, P (excess €1,500 euros)
* Group G, K, M1 (excess €1,500 euros)
* Group F3, F4, I, L, Q, R (excess €3,000 euros).
* Groups V, V1, X (excess 5000 euros)

The excess fee amount will be charged from the client’s credit card at vehicle pick up. We will reimburse the excess fee once the vehicle is returned in the same condition in which it was received.

In case of accident or damage to the vehicle, it is mandatory for the client to fill out an accident report and turn this document in at the Del Paso Car Hire office. Also, in case of vehicle theft, the customer must report the Police and turn this document into the Del Paso Car Hire office.

Any accident or damage to the vehicle that is not notified will be interpreted as negligence. This will result in an additional charge to the customer.

Del Paso Car Hire will not be held responsible for any bank fees incurred when reimbursing the afore mentioned excess fee to the customer’s account.

Partial or Total damage insurance: 

Drivers aged 70 and over must take out Delpaso's Total Coverage Insurance (this includes additional drivers)

The damage insurance (CDW) in any case does not include damage to tires, rims, hubcaps, vehicle interior, interior and exterior mirrors, windows, windscreen, latches, underbody, clutch, engine crankcase catalyst and radiator. Nor does it include the cost per battery charge loss of key, trailer crane cab to travel after the accident and error of fuel type. To partially cover these risks there is an additional coverage that may engage when collecting the vehicle.

Total Coverage: 

It will cover damages to tires, rims, windows, windscreen, underbody, loss or damage to the aerial, locks, towing and damage to the key (**) at a cost of:

*€18 euros per day (minimum of €54 euros and €252 euros maximum per rental) for groups A, A1, B.

*€21 euros per day (minimum of €63 euros and maximum of €273 euros per rental) for groups C, D, D1, E, F, F1, F2, G, H, H1, J1, M, M1, P

*€35 euros per day (minimum of €105 euros and maximum of €525 euros per rental) for group E1, F3, F4, I, K1, L, R & Q  (you will still be asked to leave a security deposit of €950 Euros due to the high value of the vehicle)

(**) Excess to deposit depending on the type of coverage option selected:

– Not taking Total Coverage, an excess fee of maximum 5000 euros shall deposit per rental.

– By taking the Total Coverage will not have to leave any excess fee. A Security Deposit is still required for Groups E1, E2 (€950 Euros), F3, F4, I, K1, L, R & Q .

– Total Coverage not available for car groups V, V1 & X

Please note that in order to rent your car you will have to indicate a valid flight number on the booking form.

Vehicles only may be driven in Spain, Portugal and Gibraltar. The vehicle must be returned to our station during office hours (if drop off is out of hours, this must be booked in advance or previously to be agreed with Del Paso Car Hire on the spot at time of picking up the car). There is an additional coverage for taking the vehicle to Gibraltar and Portugal for 9 € per day (minimum amount 27 € / maximum 90 €)

Del Paso Car Hire reserve the right to RELEASE a reservation after 2 hours from advised pick up time, if client has not advised of amended pick up times (delayed pick up time due to delayed flight arrival time will be honoured, of course, if correct flight details have been forwarded.)

Car groups V, V1 and X has an excess of 5.000 €, two credit cards in the driver´s name are requested. A deposit of 5.000 € will be charged on your credit card. The optional total Coverage is not available for these car groups

Car groups R and Q has an excess of 3.000 €, two credit cards in the driver´s name are requested. A deposit of 3.000 € will be charged on your credit card. The optional total Coverage is not available for these car groups

Mileage

If you are planning on doing a lot of kilometres, please note that you will be required to return to the local office and change the car before you reach 2000 kilometres. If you don´t return the car before the 2000 kilometres mark, a penalty of 2 Euros per kilometre will apply.

The following vehicles will have a limited mileage of 150km per day. The cost of additional mileage is €0.45 Euros per kilometre.

Groups: G, H, H1 & J1

Requirements: 

Driver´s minimum age is 21 years and he must be holding a driving license since one year, at least.

Young Driver (21-24 years) available for car categories: A, B, C, D, F1 & P €12 Euros per day with a minimum €36 Euros & maximum €100 Euros

Drivers aged 70 and over must take out Delpaso's Total Coverage Insurance (this includes additional drivers)

A current credit card in the driver´s name will be requested upon delivery of the vehicle. You will be required a valid Passport and driver license, photocopies are never accepted.

Groups may contain similar models to those specified. No model can be guaranteed in any group.

Please note that the contents of our website are aimed at users aged 16 years and above, but you must be over 21 years to hire cars using the payment methods on our website.

Buying Products on our website

To order car hire you will need to follow the ordering procedures set out on the relevant order page.

Details of the prices for the car hire and the procedures for payment and collection are displayed on or through our website. The price of the car hire is the price in force at the date and time of your order. The price of the car hire may change before you place your order. We try to ensure that the prices displayed on our website are accurate but the price on your order will need to be validated by the supplier as part of the acceptance procedure. We will inform you if the car hire price is higher than that stated in your order and you may cancel the order and decide whether or not to order the car hire at the correct price.

You undertake that all details you provide to us for the purpose of ordering car hire which may be offered by us on our website will be correct.

The following applies to any information you provide to us, for example during any registration or ordering process:

• You authorise us to use, store or otherwise process any personal information which relates to and identifies you, including but not limited to your name and address, to the extent reasonably necessary to provide the services which are available through our website by us or our suppliers. If you obtain or choose to buy car hire through our website then we may collect information about your buying behaviour and you send us personal correspondence such as e-mails or letters then we may collect this information.
• You must ensure that the personal information you provide is accurate and complete and that all ordering details contain your correct name, address and other requested details.

Applicability of Online Materials

You assume total responsibility and risk for your use of our website and use of all information contained within it. This will not affect any rights which you may have warranties or otherwise against the suppliers.

We have endeavoured to ensure that our website complies with UK law. However, we make no representations that the materials on our website are appropriate or available for use in location outside the UK.

All Products you purchase from our website irrespective of whether we are the seller or not will be covered by such guarantees and warranties as are provided by car hire supplier and we accept no liability for them. All other express or implied terms, conditions, warranties, representations or endorsements whatsoever with regard to the car hire, our website or any information or service provided through our website are strictly excluded. We will do our best to ensure that all materials and information published on our website are accurate, but please note that all materials and information on our website are provided on an ‘as is’ basis.

Exclusion of Liability

In relation to the purchase of Products, we accept no liability for any indirect or consequential loss or damage, or for any loss of data, profit, revenue or business (whether direct or indirect), however caused, even if foreseeable. In circumstances where you suffer loss or damage arising out of or in connection with the viewing, use or performance of our website or its contents other than as a direct result of purchasing car hire, we accept no liability for this loss or damage (except where we have been negligent) whether due to inaccuracy, error, omission or any other cause and whether on the part of hirecarsinspain.com or our servants, agents or any other person.

Cancellations

There are no charges made for cancelling car hire with hirecarsinspain.com, but there will be no refunds given for rentals ended early, late collections, no shows or cancellations made after the rental start date.

These terms and conditions replace all other Terms and Conditions previously applicable to the use of our website.
