By using or accessing our website, you agree to be legally bound by these Terms and Conditions of use as they apply to your use of or access to our website.

If you do not wish to be bound by these Terms and Conditions then you may not use our website.

Our website is a place for you to select and order car hire in Spain. Details of the car hire and the supplier are shown on our website next to each product. Car hire is subject to the Terms and Conditions imposed by the supplier. In the event of any conflict between the Terms and Conditions of sale of the supplier and these Terms and Conditions, the Terms and Conditions of the supplier shall prevail.

By using this site you acknowledge the contract for sale and purchase of the car hire in question is exclusively a contract between yourself and the supplier of the car hire.

You will be subject to the specific terms of the supplier of car hire set out below:

Malagacar Terms

BASIC RATE INCLUDES

• Fuel Policy - Pick up and return with the same amount of fuel. If you don´t return the vehicle with the same amount of fuel, you will be charged the missing amount of fuel.

'ALL INCLUSIVE' (FULL PACK) RATE INCLUDES

• Priority Attention with quick delivery (customers with Full Pack Rate will be attended with priority in the office) and return.
• Fully comprehensive insurance WITHOUT EXCESS, occupants insurance and insurance against theft (always and only when the keys of the car are returned and the theft has been reported to the closest police station). To avoid the car being stolen with its keys make sure you keep an eye on the keys at all time.

THE RENTAL PRICE DOES NOT INCLUDE

Insurance excess and damages to tyres, rims, hubcaps, side mirrors, windows, locks and the bottom of the vehicle. An additional insurance is available to cover the aforementioned damages at (in the case of not taking out the insurance offered in the previous point, at the time of picking up the vehicle, Malagacar.com reserves the right to charge the Excess amount as a deposit which will be returned to the client at the end of the contract if the vehicle is returned in the same conditions. Otherwise you will be charged according to the damage up to the amount marked in the attached chart):

• Vehicles that are in groups A, B, C, C1, C2 have an all risk insurance with €1000 excess. The additional insurance to cover the above mentioned damages and the excess is €12 per day with a minimum of 36 € and a maximum of €168 per 28 day rental period. For rentals of 29 days or more, the price is €6 /day.
• Vehicles that are in groups CA, D, D2, D3, D4, DA, DB, DD, F, FA, E, E2, E3, E4, EC, G, G1, G8, G9, GA, GB, JA, S1, S2, S3, SA, SB, X2, X3, X4, XB have an all risk insurance with €1200 excess. The additional insurance to cover the above mentioned damages and the excess is €14 per day with a minimum of €42 and a maximum of €196 per 28 day rental period. For rentals of 29 days or more, the price is €7 /day.
• Vehicles that are in groups F3, F4, FB, FC, FD, SE, SF, SU, SV, SW, SX, X5, X6, XC, XD, XE have an all risk insurance with €3000 excess. The additional insurance to cover the above mentioned damages and the excess is €25 per day with a minimum of €100 and a maximum of €660 per 28 day rental period. For rentals of 29 days or more, the price is €20 /day.

Additional drivers: The cost per additional driver shall be €4 per day per driver with a maximum of €40 Euros per driver per 28 day rental period. For rentals of 29 days or more, the price is €1.40 / day.

Maxi Cosi seats, Baby seats and Booster seats (*find below detailed information for each seat according to the weight of the infant / child according to regulations):

• The cost to rent a Baby seat or Maxi Cosi is €4.25 Euros per day per seat with a maximum of €51 per seat per 28 day rental period. For rentals of 29 days or more, the price is €1.80 / day.
• Isofix Baby seat on request can be rented subject to availability or type of car equipped with Isofix at the cost of €8 per day per Baby seat with a maximum of €90 per Baby seat per 28 day rental period. For rentals of 29 days or more, the price is €3.20 /day.
• The cost to rent a booster seat is €3 per day per booster seat with a maximum of €30 per booster seat per 28 day rental period. For rentals of 29 days or more, the price is €1 /day.

*Up to age 9 months and up to 10 kg: Maxi Cosi. From 9 kg to 18 kg and from 9 months to 3 years old: Baby Seat. From 15 to 36 kg and 3 to 12 years old: Booster Seat.

GPS. The cost for the rental of a GPS navigation system is 5 € per day with a minimum of 15 € and a maximum of 50 € per 28 day rental period. For rentals of 29 days or more, the price is 1.80 €/day. There will be required a deposit of 100 €.

MiFi on request, subject to availability when collecting the car. The cost of renting a MiFi device will be €4 per day with a maximum of €42 and a rental period not exceeding 28 days. For rentals of 29 days or more the price is €1.50 /day. €50 deposit is required. Only valid for use in the Peninsula. 1 GB guaranteed.

Collection of vehicles between 23 h and 8 h / 11 pm and 8 am. The collection of vehicles between the mentioned hours has a surcharge of €35.

Damages to the interior of the car, clutch, loss of keys, refuelling the wrong fuel type.

If the vehicle receives a fine during the rental period the lessee or main driver is held responsible. Said fines carries an administration cost of €40.

Malagacar.com offers a 2 hour courtesy period after the end time of the contracted rental without charge. After this time can be charged an extra day at the current rate.

Refunds for cars returned early are at the discretion of the manager. Normally no refunds are made for early return.

You are not allowed to leave Spain (Peninsula) except traveling to Portugal or Gibraltar, amounting €9 /day, with a minimum of €27 and a maximum of 90 € and a rental period not exceeding 28 days. For rentals of 29 days or more, the price is €3.20 /day.

PAYMENT

Payment is completed upon collection of your vehicle with VISA, MasterCard or AMEX credit card. Payment by debit card or in cash is accepted when the additional insurance has been taken out (that right is reserved by the company). The credit card holder must be the lessee (main driver).

DRIVERS AGE

• Groups A, B, C, C1, D and D2. 21 years of age and must have been in possession of a valid driver’s license for at least 1 year. Should the driver be younger than 25 years of age or have been in possession of his driving license between 1 and 4 years a surcharge of €4 per day is applicable with a maximum of €44 for a rental period not exceeding 28 days. For rentals of 29 days or more, the price is €1.55 /day. There is no upper age limit applicable.
• Groups E, E0, E2, E3, BA, CA and DA. 23 years of age and having been in possession of a valid driver’s license for at least 1 year. Should the driver be younger than 25 years of age or have been in possession of his driving license between 1 and 4 years a surcharge of €5.50 per day is applicable with a maximum of €75 for a rental period not exceeding 28 days. For rentals of 29 days or more, the price is €2.65 /day. There is no upper age limit applicable.
• Groups D3, F, DB, DC, FA, GA, IA, JA, G, G1, G9, CC, M1, M2, M3, M4, M5, M6, M7, M8 and M9. 25 years of age and having been in possession of a valid driving license for at least 2 years. There is no upper age limit applicable.
• Groups “P” in general. 27 years of age and having been in possession of a valid driving license for at least 5 years. There is no upper age limit applicable.

All drivers over 25 must have held a driving licence for 2 years.

OTHER DETAILS OF INTEREST

Upon collection of the vehicle you must at all times present your Passport / Identity card, driving license and a credit/debit card.
We do not guarantee car brand, model, colour or engine type when booking as we work with car groups.
Our vehicles may not leave the Peninsula.

 Groups may contain similar models to those specified. No model can be guaranteed in any group.

Please note that the contents of our website are aimed at users aged 16 years and above, but you must be over 21 years to hire cars using the payment methods on our website.

Buying Products on our website

To order car hire you will need to follow the ordering procedures set out on the relevant order page.

Details of the prices for the car hire and the procedures for payment and collection are displayed on or through our website. The price of the car hire is the price in force at the date and time of your order. The price of the car hire may change before you place your order. We try to ensure that the prices displayed on our website are accurate but the price on your order will need to be validated by the supplier as part of the acceptance procedure. We will inform you if the car hire price is higher than that stated in your order and you may cancel the order and decide whether or not to order the car hire at the correct price.

You undertake that all details you provide to us for the purpose of ordering car hire which may be offered by us on our website will be correct.

You assume total responsibility and risk for your use of our website and use of all information contained within it. This will not affect any rights which you may have warranties or otherwise against the suppliers.

We will do our best to ensure that all materials and information published on our website are accurate, but please note that all materials and information on our website are provided on an ‘as is’ basis.

Exclusion of Liability

In relation to the purchase of Products, we accept no liability for any indirect or consequential loss or damage, or for any loss of data, profit, revenue or business (whether direct or indirect), however caused, even if foreseeable. In circumstances where you suffer loss or damage arising out of or in connection with the viewing, use or performance of our website or its contents other than as a direct result of purchasing car hire, we accept no liability for this loss or damage (except where we have been negligent) whether due to inaccuracy, error, omission or any other cause and whether on the part of hirecarsinspain.com or our servants, agents or any other person.

Cancellations

There are no charges made for cancelling car hire with hirecarsinspain.com, but there will be no refunds given for rentals ended early, late collections, no shows or cancellations made after the rental start date.

These terms and conditions replace all other Terms and Conditions previously applicable to the use of our website.
